These Terms of Use (hereinafter "Terms") govern the use of the bmcb.club website and the services offered by BMCB.CLUB (Belgische Meteo Club Belge).

By accessing and using this website, you accept these Terms without reservation. If you do not accept these terms, please do not use our services.

🎯 Article 1 - Purpose and Scope

The purpose of these Terms is to define the conditions of use of the bmcb.club website and the following services:

• Access to meteorological data from the BMCB station network
• Club membership (Basic, Premium, Pro plans)
• Access to exclusive resources (guides, models, tutorials)
• Newsletter and meteorological news
• Member area with personalized access
• Contact form and technical support

🔐 Article 2 - Access and Registration

2.1 Free Access

Access to the bmcb.club website and certain basic meteorological information is free and open to any user with internet access.

2.2 Member Access

Certain features and resources are reserved for member subscribers. To access them, you must:

• Be an adult individual or a legal entity
• Complete the membership form with accurate information
• Accept these Terms
• Pay the subscription fee corresponding to the chosen plan

2.3 User Account

Upon registration, you create a secure account with username and password. You are responsible for the confidentiality of your credentials and any activity performed via your account.

In case of unauthorized use of your account, inform us immediately at helpdesk@bmcb.club.

💳 Article 3 - Memberships and Pricing

3.1 Membership Plans

BMCB.CLUB offers four annual membership plans:

^➀ Basic membership is FREE for owner of Barani device, Belgian resident, who is sharing data with us.
^➁ Support by Mail only within 7 business days.
^➂ Support by Mail only within 3 business days.

3.2 Payment Terms

Payment is made by:

• Bank transfer
• Upon request: PayPal or other agreed method

Membership becomes effective upon receipt of payment and validation by BMCB.CLUB.

3.3 Renewal

Membership is valid for one year calendar from January 1 to December 31. It is not automatically renewed. A reminder will be sent to you 30 days before expiration.

↩️ Article 4 - Right of Withdrawal

In accordance with Belgian consumer protection legislation, you have a 14-day period from the subscription to your membership to exercise your right of withdrawal, without having to give reasons.

Exception: If you have requested to immediately benefit from the services during the withdrawal period, you waive this right.

🚪 Article 5 - Termination and Suspension

5.1 Termination by Member

You can terminate your membership at any time by sending an email to helpdesk@bmcb.club.

Note: No refund will be made for the remaining membership period (except during the 14-day withdrawal period).

Your personal data will be retained in accordance with our Privacy Policy.

5.2 Termination by BMCB.CLUB

BMCB.CLUB reserves the right to suspend or terminate your access in case of:

• Non-compliance with these Terms
• Inappropriate behavior towards other members or the team
• Abusive or fraudulent use of services
• Non-payment of subscription

In case of serious breach, termination may be immediate without notice or refund.

⚖️ Article 6 - Member Obligations and Responsibilities

6.1 General Obligations

As a member, you commit to:

• Provide accurate and up-to-date information during registration
• Comply with these Terms and applicable legislation
• Not use the services for illegal or unauthorized purposes
• Respect other members and the BMCB.CLUB team
• Not share your account with third parties
• Not reproduce, distribute or resell exclusive content

6.2 Use of Resources

Meteorological resources (models, data, maps) made available are intended for personal use only. Any commercial use requires prior written authorization.

7.1 BMCB.CLUB Content

All content present on the bmcb.club website (texts, images, logos, graphics, videos, guides, tutorials) is the exclusive property of BMCB.CLUB or is subject to an authorization for use.

Any reproduction, representation, modification or exploitation of this content without prior written authorization is prohibited and constitutes counterfeiting sanctioned by the Belgian Economic Code.

7.2 Third-Party Content

Meteorological data from third-party sources (ECMWF, NOAA, Météo-France, Windy, etc.) remains the property of their respective authors. Their use is subject to the conditions of their respective licenses.

7.3 Usage License

By subscribing to a membership, BMCB.CLUB grants you a personal, non-exclusive, non-transferable and limited license to access resources for your personal use only.

BMCB.CLUB strives to ensure website availability 24/7. However, we cannot guarantee absolute availability due to:

• Maintenance operations (planned or emergency)
• Technical failures or force majeure
• Interruptions related to the hosting provider or service providers

8.3 External Links

The website may contain links to third-party websites. BMCB.CLUB has no control over these websites and disclaims all responsibility regarding their content, availability or privacy practices.

8.4 Warranty Limitation

The website and services are provided "as is" without warranty of any kind. BMCB.CLUB cannot be held liable for direct or indirect damages resulting from the use or inability to use the website.

In case of substantial modification, members will be informed by email or via a notification on the website at least 30 days before the new conditions come into effect.

Continued use of the website after the modifications come into effect constitutes acceptance of the new Terms.

⚖️ Article 11 - Applicable Law and Jurisdiction

These Terms are governed by Belgian law.

In case of dispute relating to the interpretation or execution of these terms, the parties will endeavor to find an amicable solution.

Failing agreement, the dispute will be brought before the competent courts of Belgium.
